PROOF OF LOSS:
You must submit a ‘Sworn Proof of Loss within 60 days of the date of loss’. This must be complied with since if you do not agree with the Adjusters estimate, and you filed a law suit in Federal Court the Judge typically will throw out the case for not filing a Proof. Make sure you get confirmation that the Adjuster received the Proof. In some cases where there is a widespread flood event the Administrator of the Federal Insurance Administration may put out a directive extending the Proof requirement. APPRAISAL & APPEAL PROCESS:
If you are unable to agree on the damage and cost to repair the damage with your Adjuster you have two options. Appraisal, Appeal or file suit. Best to use the Appeal process since the Appraisal is only for unit cost, not scope of damage. You need to submit the appeal within 60 days of the denial letter.
